 CREAMY LAYER IN RESERVATION.

Creamy layer in India was first used to define the affluent segment of other backward classes (OBC). The meaning of creamy layer in terms of affluent segment of the society can be better defined to understand that the 90% of forward cast in our country are under creamy layer. According to the Hinduism varnashram the first three castes naming Brahmin, ksahtriya, and vaishya are the most affluent castes that come under the creamy layer. But ironically the term creamy layer  was first used to define that segment of  society which had only 10% of the creamy layer. Since, this term is to be understood in the context of economically affluent society has never been used for the actual creamy layer. It sounds pleasant if you talk in society about one's afluence but the same sounds objectionlable in  political discussions. So far as the reservation is concerned ,it was brought in the constitution to give justice in the terms of social and political matters by providing representation in politics, administration, judiciary , police , all the government departments and the P.S.Us  run by central and state governments etc. But this system and the policy maker always misinterpreted the word representation and gave it a meaning which relates the reservation as a poverty elevation programme. Once it was  considered in economic terms the creamy layer word was very prudently pasted with the reservation system which is totally a wrong notion according to the constitution of India. The policy makers well understood that it is a foul game in reservation but they did so to deprive the maximum number of people from their rights of representation at various levels. Dr. B. R. Ambedkar speaking in the parliament during the debate on reservation had expressed his concern and apprehended that if the authorities of implementing the law will be prejudiced the constitution will not bring the results as expected . His concern became quite correct with the way the law has been implemented and the fear Dr Ambedkar had expressed in his speech is now proved to be true. To understand this we have to see some reality based on the data of the government.

According to a data received from the government under RTI act it was found that the representation of SC is around 6% ST 0-to-3% and OBC was 0-to 6% in the Ministries  and Directorates of   Central Government. This information is based on 10 years back official record. To get the latest position if we go to another RTI we hope this data of representation will be very close to zero in respect of all the SC ST and OBC category. This assumption is based on the records of government according to which  officers in bulk are getting retired   every month. Again we have seen the central government appointing various Directors , Deputy Secretary, Under Secretary in various departments under central government on lateral entry basis. In this pattern of recruitment no representation of SC ST and OBC was considered on the name of excellence.    

Under such circumstances when the reservation is stopped for creamy layer the case of representation will be become a complete failure! This is very clear that the students of SC ST and OBC have  no financial support to pursue the education in the field of medical, engineering, higher judiciary and other professional skill based jobs . The central government during last seven decades has been providing professional education and all other academic education on subsidized tution fee to the students of SC ST and OBC and it has been giving various scholarships at all levels to the students of these communities. Now this scholarship has been stopped and the tuition fee for various courses have been enhanced drastically manifold.  This step of the central government has thrown far away these students from professional education. This means the representation of these classes will never be met in the departments mentioned above. And finally if this is going to happen , the concept of  representation through reservation  will become complete failure.  This failure is a failure of the constitution as well. Hence, this is the time to stop and think again about the sentiments of the constitution regarding the representation of SC ST and OBC in the government and political system in  true word and spirit of the constitution.
